These Terms and Conditions (“Terms”) govern your access to and use of the KasiGo Deliveries mobile application, website, and related services (“KasiGo”, “we”, “us”, “our”). By using KasiGo, you agree to be bound by these Terms.

1. ABOUT KASIGO

KasiGo is a digital platform that connects customers, independent delivery drivers, and partnered stores for the purpose of food delivery and parcel delivery. KasiGo is a facilitator and does not own or manufacture the goods sold on the platform. All restaurants, merchants, and delivery partners operate as independent contractors.

2. ACCEPTANCE OF TERMS

By creating an account, placing an order, or using any part of the KasiGo app or website, you confirm that:

  • You are at least 16 years old.

  • You agree to these Terms and any additional policies posted on our platform.

If you do not agree, you must immediately stop using KasiGo.

3. SERVICES PROVIDED

KasiGo provides the following services within Phuthaditjhaba:

  1. Food Delivery

  2. Parcel / Courier Delivery

  3. Collection and drop-off services

We do not guarantee:

  • The availability of a specific restaurant or vendor.

  • That a delivery partner will accept your order.

  • That delivery times will always be exact.

4. USER ACCOUNTS

You are responsible for:

  • Keeping your account information accurate.

  • Securing your account login details.

  • All activity conducted under your account.

KasiGo may suspend or terminate your account if misuse, fraud, or policy violations are detected.

5. ORDERING AND DELIVERY

By placing an order, you agree that:

  • Prices shown in the app are determined by restaurants, vendors, or by KasiGo (for parcels).

  • Once an order is accepted by a driver and the merchant begins preparation, you may not cancel unless covered under the cancellation policy.

  • Delivery times are estimates and may vary due to distance, traffic, weather, and availability.

A delivery is considered completed once handed to you, your representative, or placed at your selected drop-off location.

6. PARCEL DELIVERY TERMS

By using KasiGo Parcel Delivery, you confirm that:

  • You will not send prohibited items (weapons, drugs, hazardous substances, stolen goods, or any illegal items).

  • You understand that parcels travel with independent couriers and may be subject to inspection if safety concerns arise.

  • KasiGo is not responsible for unsealed, poorly packaged, or undeclared fragile items.

7. FEES, CHARGES & PAYMENTS

Accepted payment methods:

  • Cash on Delivery

  • Instant EFT

  • In-App Wallet

  • Bank Transfer

Additional fees may apply, including:

  • Busy-hour surcharges

  • Long-distance fees

  • Parcel handling fees

  • Failed delivery fees (e.g., no answer at drop-off)

All payments must be made in full before or at delivery.

8. REFUNDS & WALLET CREDIT

KasiGo only issues Wallet Credit refunds, not cash refunds.

Refunds may be granted for the following:

  • Double payment / duplicate transactions

  • App or payment system errors

  • Failed delivery caused by driver or merchant

  • Expired or unsafe food

  • Damaged or spoiled products

  • Missing items

  • Incorrect order delivered

Refunds are evaluated case-by-case and may require supporting evidence (photo, video, driver report).

Wallet credit is non-transferable and cannot be withdrawn as cash.

9. CANCELLATIONS

Orders may be cancelled in the following situations:

  • No driver is available

  • Vendor cannot fulfill the order

  • Order delays exceed the acceptable threshold

  • Merchant confirms an out-of-stock item

You may not cancel:

  • After preparation has begun

  • After a driver has collected the order

  • When delays are caused by weather, traffic, or circumstances beyond KasiGo’s control

10. LIABILITY LIMITATIONS

To the fullest extent allowed by law:

  • KasiGo is not liable for the quality, safety, or preparation of food — this is the responsibility of each restaurant or vendor.

  • KasiGo is not responsible for loss, theft, damage, or deterioration of parcels unless directly caused by driver negligence proven with evidence.

  • KasiGo is not responsible for delays caused by events beyond our control (traffic, weather, network issues, strikes, etc.).

Your use of the platform is at your own risk.

11. PLATFORM ROLE

KasiGo acts solely as:

  • A platform to display products

  • A connector between customers, drivers, and vendors

  • A facilitator of payments

We do not employ drivers or restaurant staff. All partners are independent contractors.

12. VENDOR & DRIVER AGREEMENTS

By registering as a merchant or courier:

  • You confirm you are an independent contractor, not an employee of KasiGo.

  • You must comply with all local laws, health standards, licensing, and safety regulations.

  • You must maintain accuracy of your menu, operating hours, and pricing.

13. PROHIBITED USE

Users may not:

  • Abuse, threaten, or harass drivers or vendors.

  • Create fraudulent accounts or orders.

  • Send illegal or dangerous goods via parcel delivery.

  • Reverse engineer, copy, or exploit the platform.

Violation may lead to account suspension or legal action.

14. PRIVACY

By using KasiGo, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy. Data may be shared with vendors, drivers, and service providers strictly for operational purposes.

15. GOVERNING LAW

These Terms are governed by the laws of the Free State Province, Republic of South Africa. Any disputes must first be raised with KasiGo Customer Support before formal procedures.

16. UPDATES TO TERMS

KasiGo may update these Terms from time to time. Continued use of the platform indicates acceptance of the updated Terms.
